TERMS & CONDITIONS

The following Terms and Conditions are the Terms and Conditions that apply to Track Day Training (will be referred to in these Terms and Conditions as ‘Track Day Training’ or ‘us’ or ‘we’ or ‘our’) relating to the Track Day Training concept organised by us (‘Track Day Training’.)
We reserve a sole and absolute right and discretion to change, replace, modifiy, or discontinue any Application Form, these Terms and Conditions, or any ‘Track Day Training’ Web site through which these Terms and Conditions are provided (‘the Web Site’) without any liability whatsoever to you or any third party.
Descriptions

1. Descriptions of events, activities and experiences on The Website or in promotional literature are as accurate as possible. Track Day Training reserves the right to vary equipment, schedules, timings and facilities either before or after a booking has been made. Where such variations occur, Track Day Training will use reasonable endeavour (such endeavours being subject to alternatives being available, and subject to Track Day Training’s right to change the price applicable) to offer reasonable alternative and you agree to accept such reasonable alternative.
2. Track Day Training has the right to change the price of any event, activity or experience at any time prior to a booking being accepted. When such a change occurs, the revised price must be paid in accordance with the ‘payment terms’ clause (below).

The Contract

1. The Terms & Conditions constitute the agreement between you and Track Day Training and supersede any earlier agreement.
2. The contract between you and Track Day Training is made when you confirm the requirements by letter or facsimilie and Track Day Training has accepted your requirements by confirmation by letter or facsimilie being proof of such acceptance.

Payment Terms

1. Card payment can be taken on booking and is non refundable if the booking is cancelled within 10 days of the event.

Failure to Pay

1. If payment is not made within the terms (above) this will be a breach of contract and Track Day Training will treat the contract as terminated. If the contract is terminated, Track Day Training is entitled to retain any sums already paid by you. Any outstanding balance or cost of the booking shall become payable to Track Day Training by you.

Limitation and Liability

1. Track Day Training is not liable for any refund in the event that a booked event, activity or experience is cancelled or postponed but will endeavour where possible to offer an alternative date to that booked.
2. Track Day Training is not liable for any omission by any person not employed by Track Day Training, nor the actions or omissions of organisers or operators of a venue, their servants, agents or employess.
3. Track Day Training is not liable for any loss, damage or expense caused by cancellation of any event, activity or experience due to circumstances outside of the control for Track Day Training. Such circumstances include (but not limited to) government action, strike, civil unrest, national disaster or any force majeur.
4. Track Day Training is not liable for any loss, damage or expense sustained to your property or belongings incurred or suffered by you that arise from a booking.

Except where prevented by statute, Track Day Training is not liable in respect of death or personal injury suffered by you arising from a booking. Prior to any track event you must sign and indemnity form for both the hosting venue and Track Day Training.
